10 Schuylkill County Businesses Cited for Not Abiding by COVID-19 Mandates


The Pennsylvania State Police, Bureau of Liquor Control Enforcement office in Allentown announced on Tuesday that 10 Schuylkill County licensed establishments have been cited for failing to abide by COVID-19 mandates as well as other violations during the months of February and March.

The violations listed below will be brought before an Administrative Law Judge (ALJ) who has the authority to impose penalties ranging from $50-$13000 for minor offenses and up to $5,000 for more serious offenses. In addition, the ALJ can also impose a license suspension or revocation of the license based on the severity of the charge brought. The ALJ can also mandate training for the licensee in an effort to educate them on the requirements of being a licensee.
 

Mulligans, S. Main Street, Shenandoah

Cited for:
  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID„19 disaster emergency, in that you did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment and allowed a patron to be seated at the bar on February 13, 2021.

Bums Rush Restaurant and Pub, RTE 61 , Orwigsburg

Cited for:
  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, allowed a patron to be seated at the bar, and did not provide at least six feet between parties or physical barriers between customers where booths are arranged back to back on February 20, 2021.
  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting, or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, allowed a patron to be seated at the bar, and did not provide at least six feet between parties at tables or physical barriers between customers where booths are arranged back to back on March 6, 2021.

  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, sold and/or served alcohol to a patron for on-premises consumption in a transaction that did not include a meal, allowed a patron to be seated at the bar, permitted patrons to consume alcohol and/or food while not seated at tables or booths, and sold, furnished or gave alcoholic beverages for on-premises consumption after 11:00 p.m. on February 19, 2021.
  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, sold and/or served alcohol to a patron for on-premises consumption in a transaction that did not include a meal, allowed a patron to be seated at the bar, permitted patrons to consume alcohol and/or food while not seated at tables or booths, sold, furnished or gave alcoholic beverages for on-premises consumption after 1 1 p.m., and permitted patrons to possess and/or consume alcoholic beverages on the licensed premises after midnight on February 20 and 21 , 2021.

  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear facemasks at all times while at the establishment and allowed a patron to be seated at the bar on February 17, 2021.
  • Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, did not provide at least six feet between parties at tables or physical barriers between customers where booths are arranged back to back, sold and/or served alcohol to a patron for on-premises consumption in a transaction that did not include a meal, allowed a patron to be seated at the bar, permitted patrons to consume alcohol and/or food while not seated at tables or booths, sold, furnished or gave alcoholic beverages for on-premises consumption after 1 1 p.m. and permitted patrons to possess and/or consume alcoholic beverages on the licensed premises after midnight on February 21 , 2021.

Cited for:
  • Failed to maintain complete and truthful malt or brewed beverage dispensing system cleaning records, in violation of Section 493(12) of the Liquor Code, and Section 5.52 of the Liquor during the of period February 24, 2020 through February 20, 2021.
  • Failed to clean malt or brewed beverage dispensing system at least once every seven (7) days on July 8, September 21 and November 9, 2020.
