A Mahanoy City man is facing assault and terroristic threats charges after Pennsylvania State Police alleged he attacked a juvenile and threatened several family members during a domestic incident early Monday.
Charges Filed Following Mahanoy Township Incident
Jayson Hierro-Delacruz, 34, was charged with one count of simple assault, two counts of terroristic threats and three counts of harassment.
According to an affidavit of probable cause filed by state police, troopers were dispatched to a residence in Mahanoy Township around , for a reported active domestic incident.
Troopers Describe Alleged Assault and Threats
When troopers arrived, they found several people arguing outside the residence. An adult family member told police that Hierro-Delacruz had allegedly knocked out his nephew.
While attempting to separate those involved, troopers reported seeing the juvenile with blood coming from both nostrils. Hierro-Delacruz was then detained and placed in a patrol vehicle.
An adult witness told investigators that family members called him and reported that Hierro-Delacruz was striking the juvenile. When the witness arrived, he allegedly saw Hierro-Delacruz punching walls.
The witness alleged that Hierro-Delacruz threatened to kill him and his family before knocking a woman to the ground. Hierro-Delacruz also allegedly warned the witness about what would happen if he spoke to police.
A juvenile witness told investigators that she was awakened by her siblings and went downstairs, where she allegedly saw her brother on the floor while Hierro-Delacruz struck him. She reported attempting to separate Hierro-Delacruz from her family members, according to the affidavit.
The injured juvenile was taken to a hospital by his grandmother to be evaluated.
Police transported Hierro-Delacruz to the Frackville State Police barracks. While in custody, he allegedly made unsolicited statements, admitted shoving one family member and said another family member was “lucky to be alive after what she put him through,” the affidavit states.
Bail Posted and Preliminary Hearing Scheduled
Bail was set at $20,000. Court records show the bail was posted through a professional bondsman later Monday.
A preliminary hearing is scheduled for , before Magisterial District Judge Anthony J. Kilker.
All charges are allegations. Hierro-Delacruz is presumed innocent unless and until proven guilty in court.
