Schuylkill County Businesses Cited by the Liquor Control Enforcement

 

The following Schuylkill County businesses were cited recently for Liquor Control Violations.

According to the Pennsylvania State Police, Bureau of Liquor Control Enforcement, the following businesses will have charges brought before an Administrative Law Judge who has the authority to impose penalties ranging from $50-$1,000 for minor offenses and up to $5,000 for more serious offenses. In addition, the ALJ can also impose a license suspension or revocation of the license based on the severity of the charge brought. The ALJ can also mandate training for the licensee in an effort to educate them on the requirements of being a licensee.

VGV Beverages Mahanoy City
  • On February 7, 2023, you, by your servants, agents or employees, sold alcoholic beverages on credit in contravention of the provisions of the Liquor Code and Title 40 of the Pennsylvania Code, in violation of Section 493(2) of the Liquor Code and Sections 11.192 and 11.193 of the Liquor Control Board Regulations.
  • On January 31, February 2 and 7, 2023, you, by your servants, agents or employees, possessed or operated gambling devices or paraphernalia or permitted gambling or lotteries, poolselling and/or bookmaking on your licensed premises, in violation of Section 471 of the Liquor Code and Section 5513 of the Crimes Code.
  • On February 7, 2023, you, by your servants, agents or employees, failed to display on the licensed premises documentary evidence that the premises meets all sanitary requirements for a public eating place, in violation of Section 5.41 of the Liquor Control Board Regulations.
  • On February 7, 2023, you, by your servants, agents or employees, failed to constantly and conspicuously expose restaurant liquor license under a transparent substance on your licensed premises, in violation of Section 467 of the Liquor Code.
  • During the period November 4, 2021 through February 7, 2023, you, by your servants, agents or employees, operated another business on your licensed premises without Board approval, in violation of Section 3.52(c) of the Liquor Control Board Regulations.
Pocono Enterprises Co., Shenandoah
  • On October 28; December 2, 3 and 16, 2023, you, by your servants, agents or employees, used, or permitted to be used on the inside and/or outside of your licensed premises, a loudspeaker or similar device whereby the sound of music or other entertainment, or the advertisement thereof, could be heard beyond the licensee's property line, in violation of Section 493(34) of the Liquor Code.
  • On October 28; December 2, 3 and 16, 2023, your licensed establishment was operated in a noisy and/or disorderly manner, in violation of Section 471 of the Liquor Code.
Share Ganesh LLC, Saint Clair
  • During the period June 29 through November 9, 2023, you, by your servants, agents or employees, failed to maintain complete and truthful malt or brewed beverage dispensing system cleaning records, in violation of Section 493(12) of the Liquor Code and Section 5.52 of the Liquor Control Board Regulations.
  • On November 4, 2023, you, by your servants, agents or employees, failed to clean malt or brewed beverage dispensing system at least once every fourteen (14) days, in violation of Section 5.51 (c) of the Liquor Control Board Regulations.
  • On September 1, October 21 and 25, 2023, you, by your servants, agents or employees, possessed or operated gambling devices or paraphernalia or permitted gambling or lotteries, poolselling and/or bookmaking on your licensed premises, in violation of Section 471 of the Liquor Code and Sectic,r\ 5513 of the Crimes Code.
  • On October 25, 2023, you, by your servants, agents or employees, failed to display on the licensed premises documentary evidence that the premises meets all sanitary requirements for a public eating place, in violation of Section 5.41 of the Liquor Control Board Regulations.
Hang Loose, Tamaqua
  • On December 14, 2023, you, by your servants, agents or employees, used, or permitted to be used on the inside and/or outside of your licensed premises, a loudspeaker or similar device whereby the sound of music or other entertainment, or the advertisement thereof, could be heard beyond the licensee's property line, in violation of Section 493(34) of the Liquor Code.
Sheetz, Schuylkill Haven
  • During the period June 22, 2019 through September 17, 2023, you, by your servants, agents or employees, failed to comply with the requirements of Section 471.1 of the Liquor Code regarding responsible alcohol management, in violation of Sections 471.1 (h) and 415(a)(6) of the Liquor Code and Section 5.205 of the Liquor Control Board Regulations.
Country Squire, Schuylkill Haven
  • During the period May 25, 2023 through January 4, 2024, you, by your servants, agents or employees, failed to return your hotel liquor license and wholesale liquor purchase permit cards to the Board after your licensed establishment had not been in operation for a period of fifteen (15) consecutive days, in violation of Section 474.1 (a) of the Liquor Code and Section 7.31 (a) of the Liquor Control Board Regulations.
  • During the period October 1 through December 18, 2023, you, by your servants, agents or employees, failed to have your Board-approved manager complete RAMP owner/manager training within 180 days of the Board's approval of the appointment, in violation of Section 4 71.1 (g) of the Liquor Code.
