Two Schuylkill County Businesses Cited for Failing to Abide by State Orders and Mandates During COVID-19 Disaster Emergency

Two Schuylkill County business were cited recently for not abiding by Pennsylvania State orders during the COVID-19 disaster emergency.

The following licensed establishments were cited by the PA State Police, Bureau of Liquor Control Enforcement, Allentown District Enforcement Office.

Mazloom Inc, located at 57-59 Valley Street, New Philadelphia.

According to the public information report, Failed to abide by the order and mandates of the Governor and/or Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you did not require all customers to wear face masks while entering, exiting or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, and sold and/or served alcohol to a patron for on-premises consumption in a transaction that did not include a meal on October 22, 2020.

According to the public information report - Failed to abide by the order and mandates of the Governor and/or the Secretary of Health, related to businesses in the restaurant and retail food service industry permitted to operate during the COVID-19 disaster emergency, in that you allowed a patron to be served or seated at the bar, did not require all customers to wear face masks while entering, exiting, or otherwise traveling throughout the establishment, did not provide face masks for employees to wear at work or did not require employees to wear face masks at all times while at the establishment, permitted patrons to consume alcohol and/or food while not seated at tables or booths, sold and/or served alcohol to a patron for on-premises consumption in a transaction that did not include a meal, sold, furnished or gave alcoholic beverages for on-premises consumption after 11:00 p.m., allowed patrons in excess of 25% of the fire code limitations within your licensed premises for the purpose of indoor dining without enrolling in the Open & Certified Pennsylvania Program, and did not provide at least six feet between parties at tables or physical barriers between customers where booths are arranged back to back on October 24, 2020.

These charges will be brought before an Administrative Law Judge (ALJ) who has the authority to impose penalties ranging from $50-$1,000 for minor offenses and up to $5,000 for more serious offenses. In addition, the ALJ can also impose a license suspension or revocation of the license based on the severity of the charge brought. The ALJ can also mandate training for the licensee in an effort to educate them on the requirements of being a licensee.
