David Jesus Lopez, 23, of Leola, was charged by West Penn Township Police with aggravated assault, terroristic threats, crimes committed with a firearm, firearms not to be carried without a license, and recklessly endangering another person. The incident is alleged to have occurred on December 8, 2025.
According to police, officers were dispatched around 5:45 p.m. to a report of shots fired at a residence on Forsythia Lane in West Penn Township. Upon arrival, officers spoke with a man, who reported an altercation with a delivery driver. The victim stated the driver was speeding along the dirt lane, prompting him to yell for the driver to slow down. An argument ensued after the driver exited his vehicle, at which point the victim alleged the driver produced a firearm, pointed it at him, threatened to shoot him, and fired a single round into the ground before fleeing the area.
Police located a spent 9mm shell casing at the scene, consistent with the victim's account.
Investigators determined the suspect had just completed a package delivery in the area. Police traced the delivery through Walmart records and identified the driver as David Lopez. Asset protection personnel at Walmart were able to confirm Lopez as the delivery driver, and his photograph matched images associated with the delivery confirmation.
West Penn Township Police coordinated with St. Clair Police and Walmart staff in St. Clair, where Lopez was expected to return for another delivery. Lopez was taken into custody by St. Clair Police upon arrival at the store. Police reported Lopez was found in possession of a 9mm handgun concealed in his waistband inside his vehicle, a black Honda Pilot bearing New York registration.
Authorities stated the magazine recovered from the firearm contained seven rounds, and the ammunition matched the shell casing recovered at the scene. A records check revealed Lopez does not possess a license to carry a concealed firearm. Lopez was advised of his Miranda rights and declined to make a statement.
Lopez was arraigned by Magisterial District Judge Andrew Serina and committed to Schuylkill County Prison on $100,000 straight cash bail. A preliminary hearing is scheduled for December 16, 2025.
