Pottsville Home Intruder in Custody; Port Carbon Man Faces Aggravated Assault and Burglary Charges


A Port Carbon man is locked up in Schuylkill County Prison after a home invasion in Pottsville on Tuesday morning.

According to Pottsville Police, on Tuesday November 7, 2023, around 6:30am, Pottsville Patrolman Youse was dispatched to a residence in the 300 block of Peacock St for a report of the caller’s ex-boyfriend trashing the caller’s house.

During the police investigation it was determined that Justin Marx, 33, of Port Carbon arrived at the victim's home during the early morning hours. 

Marx scaled a fence to the rear of a residence in the 300 block of Peacock St. and climbed onto the roof of that property. From there he jumped onto the balcony roof of the home of the victim and entered the building through a closed window on the 3rd floor. 

The victim was sleeping in the bedroom when he entered. Once Marx was inside the victim confronted him immediately, yelling at him to get out of the house.

The victim reported that Marx spit on her and then bit her forehead before he grabbed an aluminum softball bat and swung it at the victim, striking her in the ankle.

At this point, the victim stated she was going to call the police, which Marx grabbed her phone and ran outside throwing the phone in a trash can filled with water. Marx left the house.

Marx returned around 1:30am and the victim met him outside in an attempt to de-escalate and avoid any additional issues. 

As she attempted to walk away from Marx, who was already in his vehicle, he quickly turned around pulled his white Jeep in front of her blocking her path. She opened the passenger front door and began arguing with Marx. While the victim was inside the door frame, Marx quickly put the Jeep in reverse and backed up, attempting to hit the victim with his car door. She was able to jump out of the way evading any injury.

Marx then disconnected the electrical box from the wall of her home, causing the power to go out in the house. Marx attempted to get into the house, however she would not let him in. The victim went out onto her 2nd floor front porch and was arguing with Marx who was on the ground level. That is when Marx threw 2 unopened 12-ounce beer cans at her, striking her in the right shin and stomach. 

Marx again went to the 3rd floor window and attempted to enter the house, which the victim locked the window at that point.

The victim left for work and when she returned, she noticed all her clothes on the ground outside and the apartment was trashed inside.

Pottsville police issued a warrant for Marx's arrest charging him with felony aggravated assault, felony burglary, felony criminal trespass, misdemeanor simple assault and reckless endangerment, and summary harassment.

The Pennsylvania State Police, and the Blythe Township Police Department picked up Marx on the warrant in Cumbola later in the day. 

Marx was arraigned by Magisterial District Judge Edward Tarantelli and locked up in Schuylkill County Prison on $75,000 straight cash bail.
